On Jan. 26, 2017, a photo of an unknown 27-year-old man appeared on the web page of the German BKA (Federal Criminal Police Office). Investigators accused him of abusing a girl of about eight years old several times from June 2014 to August 2015 and distributing recordings of it on the darknet. Image and video files of at least 26 cases of abuse against the girl had been found on a child pornography platform. The suspect had also posted photos of himself online. „That pictures of suspects are found on the darknet is unusual,“ said Georg Ungefuk of the Central Office for Combating Internet Crime, a department of the attorney general’s office.
The man was arrested the same day in the Traunstein district of Upper Bavaria, near Munic. There had been numerous tips and „valid approaches in the middle double digits,“ said senior prosecutor Georg Ungefuk.
10/17/2017 – Trial of the accused.
The prosecution lists a total of 29 cases of abuse: The acts are said to have occurred between March 2014 and January 21, 2017 – that is, until shortly before the arrest of the Traunreuter (the man from Traunreut) , in which the authorities asked the public for assistance. When the acts allegedly began, the girl allegedly abused was just seven years old.
The attorney general’s office secured extensive evidence because the defendant probably filmed and photographed the acts on a regular basis. In one case of sexual abuse in July 2015, the girl was so severely injured in the intimate area, according to the prosecution, that she subsequently had to be treated as an inpatient in hospital.
In addition, the 28-year-old Traunreuter is accused of having shared the photos and videos via the messenger „Skype“ with four users.
The man is charged with simple sexual abuse of children in 15 cases and serious sexual abuse of children in 14 cases. Also: production of child-pornographic writings and negligent assault.
Prosecution
The trial begins, the prosecutor reads the indictment: The accused is said to have practiced all possible forms of sexuality with the young girl. This was often filmed or photographed.
In July 2015, there was even a case where the then eight-year-old girl had to be hospitalized after sexual intercourse. The public prosecutor’s office speaks of „heavily bleeding injuries in the vaginal area“.
Defendant confesses to everything
The defendant confesses to everything. Denial would have been difficult for him in view of the videos and photos. This has the advantage that the victim, his stepdaughter, does not have to be questioned in court.
A seven-year-old as a substitute for the ex-wife
How could it come to this? The relationship with the defendant’s ex-wife broke down after about two years: „My wife then only slept on the couch – and the little girl with me. We always had a good relationship,“ says the man from Traunreut: „I then, more or less, appropriated her as a partner.“ The prosecution accuses him of 29 acts, but the defendant admits to having assaulted the child a total of more than 50 times.
He not only sent the recordings with the girl to Skype users abroad, but also openly offered them for download. According to the prosecutor, the pictures eventually circulated all over the Internet.
As if it was a normal relationship…
The defendant often describes the relationship with the stepdaughter as if it was a normal relationship. „The girl was like a friend, I was in love. In 2016, I met another woman. But the little girl then became really loud,“ said the Traunreuter. „No, I don’t want you to have a new girlfriend. You have me, after all. Otherwise I’ll tell everything we did,“ the child is said to have said in response.
The judges doubt this euphemistic story. „I’m scared, I never want to go back to him,“ the girl finally testified to the police. The 28-year-old doesn’t seem to want to hear that: „She was the happiest child with me. You can ask dozens of people. You can’t pretend that way,“ he is convinced. „Have you ever thought about what you’re breaking with the child?“ asks the sitting judge – the defendant shrugs his shoulders, „I didn’t think anything of it.“
The girl’s hospital stay
The defendant also comments on July 19, 2015, the day the girl was taken to the hospital: „It wasn’t intentional on my part. I also apologized to her…“ They had only rubbed against each other, there had been a touching of the genitals. The girl was bleeding.
The accused finally went with the girl to the examination: „The female gynecologist also said that there was nothing abnormal. She did not exert any pressure on the victim. However, the child described it differently in the police interrogation: She admitted to having told a „story“ in the hospital because otherwise there would be consequences for the defendant.
What did the mother witness?
After the separation, the mother had custody, but ten to 15 days a month the girl spent time with the defendant. The mother was already suspicious, but when she asked him if he had touched her, a nasty argument ensued – which ended in his ex-wife’s suicide attempt. The woman also became skeptical when she saw a kissing photo of the defendant and the victim.
According to the defendant, his ex-wife was jealous of her own daughter: „The little girl kissed me on the couch. That’s when my ex said we should get a [hotel-] room right away.“ When cuddling while watching TV, they had also touched each other intimately for the first time.
The interrogation of the girl
A female police officer who questioned the victim also testified: „It went well, almost like with an adult,“ the witness reported. The girl – ten years old at the time of the interrogation – had immediately known what it was all about. During the interrogation, the child independently used the terms „fuck“ and „sperm“ and was able to name everything clearly.
The police officer described the victim as a „small and petite girl“, who outwardly appeared two years younger. She was bubbly and lively, she said. „I don’t think she was afraid of him. I don’t think there was ever any violence involved, either. But still, she didn’t want it. There was a lot of habituation involved.“
The defendant’s biography
„My childhood was quite normal, quite natural,“ the defendant also reported about his life. He completed his apprenticeship in retail, then worked for years, mainly as a temporary worker, in two Traunreut industrial companies. He was married to the ex-wife for a total of six years: „Everything was wonderful.“
About two years after the wedding, out of curiosity, he started using drugs, speed, marijuana, legal highs. Every day the 28-year-old took something: „It changed my character.“ After two years, he let go of it, but then drank about seven half beers a day. Nevertheless, he was usually clear-headed; he was used to alcohol.
The expert opinion
A psychological expert is the last witness on the first day. How does he assess the defendant? He is not a „core pedophile“ who has always been oriented toward children. After all, the man from Traunreut had also had contact with a 19-year-old girl during the time of the abuse – a date was planned. Nevertheless, he said, one must naturally assume that he is a pedophile.
„Actually, he is not into children, he said to me,“ says the psychologist. This, in turn, is contradicted by the fact that he not only offered „his“ child pornography on the Internet, but also downloaded much of it himself.
To the expert witness, the 28-year-old had also stated that the young girl had made the first move, an accidental grab at the penis when they were both dressed. Then things got out of hand: Together they watched porn animations on the PC – the next step was then practice. „He said he never forced her,“ says the expert witness.
Despite the Traunreuter’s alcohol consumption, there was no evidence that the defendant’s ability to understand or control was impaired, he said. „He was already aware of the injustice later, but he did not consider the girl a victim. That is not uncommon with such offenders.“

Letters of the accused
At the beginning of the second day of the trial, presiding judge Weidmann read out a letter that the defendant had written from custody to an acquaintance:
„I am already afraid of what will happen after the U custody,“ he wrote in the letter: „I want to start a new life, move away from here and finish with everything.“ He testifies ruefully, „I had a good life, but have now ruined everything. In prison, I now realize what I have done.“
He goes on to write, „I want to show that I am not a monster who is dangerous to other people. I am so ashamed and sorry. I don’t know what to do to make people believe that I am not like that.“ He said he is glad that at least his family stands by him. He feels most sorry for his stepdaughter. „I regret my past and want a fresh start.“
But immediately afterwards, Judge Klaus Weidmann read out – at least in excerpts – further letters from the defendant. They were, even before the arrest, addressed to his abused stepdaughter: „You are so horny and dirty (‚geil‘ and ‚versaut‘),“ it says among other things. He was already looking forward to sex with her again, wanted to always be there for the girl and marry her later.
It also became known that the public prosecutor’s office immediately contacted Facebook after the arrest: it was ordered that the Facebook accounts of the defendant and the girl be blocked.
Finally, the lawyer for the plaintiff made a request: the man from Traunreut should pay the girl at least 45,000 € in compensation for her pain and suffering. At the moment, however, he is penniless. In addition, all further damages for the girl, which could still come and stem from the sexual abuse, are to be replaced by him.
The prosecution’s plea:
„These acts clearly rise above the cut,“ concludes the prosecutor. Seven years and eleven months should the 28-year-old Traunreuter in prison. The accusation: sexual abuse of children, in 14 of the 29 cases seriously, in addition production of child pornographic writings and negligent bodily injury.
The prosecutor knows: In addition to the charge, there were probably about 20 other cases of abuse. They were not filmed or photographed by the defendant. „We deliberately wanted to try only cases where we did not have to call the girl as a witness.“
„The girl was objectified by the sharing of the pornography and by the specific sex practices,“ the prosecutor argues. The videos and photos were „for all time no longer retrievable on the Internet on the road.“ In addition, the Traunreuter would have tried to relativize the acts: „I have the feeling he wanted to unload some responsibility for it on the child.“
In the defendant’s favor was the fact that he had fully confessed from the outset, had not yet come to light in criminal proceedings and lived in fairly orderly circumstances. In addition, he agreed to the claim for compensation for pain and suffering. The joint plaintiff, without a concrete demand for punishment, agrees with the prosecutor: „For the child, the crimes are for life. It will always be remembered.“
According to the mother, the impairments for the girl are „currently manageable.“ Penalty aggravating factors, he said, are the long period of offenses and the child’s age, which is considerably below the protective limit of 14 years.
The amount of the punishment was not decisive for the victim, emphasized accessory prosecution representative Marlies Kruse from Traunstein, and recalled that the child had asked the police for a „life sentence“ for the perpetrator: „But these experiences are life sentences for the girl. Any relationship will bring back the memories.“
Ms. Kruse missed „real victim empathy“ in the 28-year-old: „He’s trying to put a Lolita function on the seven-year-old.“
The defense attorney, Michael Vogel from Traunstein, spoke of a clear evidence situation. Despite this clarity, he said, much was incomprehensible. The distribution of roles in the family was part of his perplexity, he said. A sexual relationship between a man and a child is also incomprehensible to him.
But it is also necessary to question certain behaviors of the victim, the lawyer said. From his point of view the request of the senior public prosecutor is too high, a prison sentence between four and five years is appropriate.
In the „last word“, the 28-year-old affirmed his remorse and his willingness to undergo therapy: „I am infinitely sorry for the whole thing. I screwed up big time.“
In the verdict, presiding judge Dr. Klaus Weidmann stated that, in addition to the confession, the pictures and data were the second pillar of the evidence. The mother had reported on the current condition of the girl. In addition, there was the „alarming injury picture“ of the girl, attested by a clinic.
The range of punishment ranged up to 15 years. A violent or coercive environment had not prevailed during the acts. However, the fully culpable defendant had committed serious acts over a long period of time against a very young child. On the other hand, the 28-year-old had spared the victim by his confession.
What is written in the medical record
The diagnosis: vague, vaginal bleeding, abdominal pain, no foreign body insertion. „Very anxious, skin pale,“ the file further notes. The next day, the child was discharged from the hospital again: „In good general condition,“ it says. The file passed through several hands in the hospital, two doctors had signed it.
What had happened in the Traunreut apartment on July 19, 2015 before? The girl had been lying on top of him and they had „just rubbed against each other,“ according to the 28-year-old’s version. There was at least one touching of the genitals, a partial penetration. A wound appeared, but wiping it with a washcloth did not make it better.
The girl resisted further investigation
In fact, the girl probably did a lot to avoid suspicion at the hospital. It told there „a story“, the girl admitted later to the police. Her stepfather had warned her that there would be consequences for him otherwise. Further, the medical record states, „The patient did not allow herself to be further urogenitally examined.“ Also according to Judge Weidmann, the eight-year-old child must have been very resistant to further examinations.
The verdict
The defendant must go to prison for seven years and nine months. Thus, the court remains only minimally below the plea of the prosecution. The 28-year-old is guilty of sexual abuse of children in a total of 29 cases – including 14 cases of aggravated sexual abuse. In addition, there is possession and production of child pornographic writings and negligent bodily injury.
And: The Traunreuter must pay for all further damages that could still come to the girl because of the sexual abuse, as far as the social insurances are not liable.
„In the worst case, the child could come across the pictures again in a few years,“ says Judge Weidmann – after all, you can’t get them out of the Internet. Despite a possible care for the child, the defendant had made it a sexual object.
The judge justifies the fact that the sentence is not harsher primarily with the full confession: „That contributed to the protection of the victim. Otherwise we would have had to interrogate the girl, go into many details again – it would have meant an enormous burden and retraumatization for her.“ The 28-year-old would also have expressed remorse and regret.

The German Penal Code allows for early release after two-thirds of the prison term if the prisoner does not pose a danger to the general public, is also in a favourable social environment and his behaviour during prison allows for a favourable prognosis. The prisoner from Traunreut could have fulfilled these conditions. He could then have been released at the end of 2022.
